Burman Hospitality sends legal notices to hospitality developer Epicuria for overcharging

Burman Hospitality, which has franchisee rights for Yum Restaurants-owned Taco Bell, has sent legal notices to hospitality developer Epicuria, alleging over-charging on maintenance issues involving electricity billing.

aurav Burman, promoter of Burman Hospitality, has also written to the national restaurant association and hotel association against Epicuria, alleging over-charging of bills. ET has seen a copy of the letters.

The letters, addressed to the National Restaurant Association of India (NRAI) and Federation of Hotel and Restaurant Association of India (FHRAI), request both industry organisations to “intervene in light of the gravity of the situation”, and take “appropriate action against V. Cubed and Sapphire”.

Burman Hospitality had entered into a sub-licence agreement with V. Cubed and Sapphire Projects, both individual entities operating under Epicuria, in 2016, to set up Taco Bell.

The letter by Burman alleges that since mid-2016, V. Cubed and Sapphire have sent ‘illegal demands’ on account of electricity charges without supporting documents. “The bills concerned are being fudged and fabricated without actual meter readings…” It alleges that despite repeated requests, it has not been provided original copies of bills.

Epicuria co-founder Vivek Bahl, on his part, said there has been no over-charging. “We have a commercial agreement with them (Burman Hospitality); there are certain bills which they are refuting. We are trying to see what can be resolved…. we are not over charging and have nothing against anyone,” Bahl explained.

The national restaurant association said it does not comment on matters between two commercial entities. NRAI president Rahul Singh said: “NRAI does not comment on legal/ contractual issues, disputes between two parties or any internal matters of any company, even if they are members.”

Buman Hospitality has also alleged that other brands too may have been impacted. “We have come to realise and prove beyond doubt that since the inception of this relationship, we have been subjected to illegal charges against electricity bills. We have also come to suspect that this illegal activity by these entities has been carried out against every restaurant set up within Epicuria.”
